The website www.orpheudecor.com, hereinafter referred to as ORPHEU DECOR, is managed by the company VALEFERRUGEM, UNIPESSOAL LDA, juridical person no. 513 895 582, with registered office at Travessa da Ferrugem, n. º 62, 4750-796 BARCELOS, with the email address: info@orpheudecor.com.

PURPOSE AND APPLICATION SCOPE

These General Terms and Conditions of Hiring and Use apply to the customers of the website www.orpheudecor.com, as well as to any commercial transactions carried out through it. This document establishes pre-contractual information on contracts concluded at a distance through the website www.orpheudecor.com.

The use of the terms “we”, “our” and “us” refer to the website www.orpheudecor.com, also known as ORPHEU DECOR.

The browsing on the website www.orpheudecor.com, as well as the purchase of any product, imply the acceptance of these General Terms and Conditions of Hiring and Use.

ORPHEU DECOR reserves the right to modify these General Terms and Conditions of Hiring and Use without prior notice, with any changes being published on the website www.orpheudecor.com.

AMENDMENT OF THE PRESENT CONDITIONS

ORPHEU DECOR reserves the right to change the contents of the website, the services provided, as well as the General Conditions of Hiring and Use, at any time, and without prior notice.

LIABILITY AND EXCLUSIONS

ORPHEU DECOR accepts no liability for damages caused by interferences, computer virus, interruptions, malfunctions, disconnections or any other situations that prevent the access or correct functioning of the website www.orpheudecor.com, as well as the services available in it.

ORPHEU DECOR is not responsible for damages caused by delay, default or defective fulfilment of any occurrence that is not directly attributable to it, as a fraud or fault, in particular by occurrences associated with errors, omissions or inaccuracies regarding the information made available on the products, for damages caused by infringement of intellectual property, breach of obligations of the manufacturer, annulation and cancellation of orders already made, among others.

ORPHEU DECOR is not responsible for any possible violation of the destination country laws, being the Customer’s responsibility to ensure that the local authorities have the conditions for importing or using the products that you wish to purchase.

ORPHEU DECOR is not responsible for the impossibility of the order being delivered due to restrictions in the country of destination, reserving the right to cancel the order.

ORPHEU DECOR accepts no liability for any errors or omissions on the website www.orpheudecor.com.

The abusive or fraudulent use of the information obtained through the website www.orpheudecor.com are the sole responsibility of each user, as ORPHEU DECOR denies any responsibility for that use.

In case of a dispute arising from the application of these General Conditions of Hiring and Use, the Court of the County of Barcelos shall have jurisdiction with express waiver of any other.

INTELLECTUAL PROPERTY

The contents available on the website www.orpheudecor.com are owned by ORPHEU DECOR and third parties, namely the producers, manufacturers and brands that we commercialize.

All the information provided on the website www.orpheudecor.com is protected under the legal provisions applicable to industrial property. The total or partial reproduction of the information provided is strictly prohibited and requires prior written authorization from the respective owners.

The Customer may print, save or display the contents of this website exclusively for his personal use.

PRIVACY

ORPHEU DECOR has access to some of your personal information, whenever you use our website or place an order. Nevertheless, all data is treated as confidential and, therefore, is never shared nor disclosed to third parties. The only exceptions are companies and/or organizations responsible for solving technical problems on our website and/or involved in the fulfilment of all orders, namely payment processing platforms and courier services.

By using our website, the Customer guarantees that all the data provided to ORPHEU DECOR is correct and complete.

PRICES

The prices shown at the website www.orpheudecor.com are final retail prices for end consumers. The prices indicated do not include custom taxes nor shipping costs. Depending on the value of the purchase and country of delivery, shipping may be free. However, any import tax shall be borne by the Customer.

We are committed to providing the best possible service, but it is possible that the prices indicated on our website may be wrong. If an error is found in the price of one of our products, the Customer will be informed immediately, and will be able to confirm the order with the corrected price or to cancel it. If there is any difficulty in contacting the Customer, the order will be cancelled and the Customer will be refunded in full for the amount paid.

Product prices on our website are subject to change without prior notice.

AVAILABILITY OF PRODUCTS

All the orders placed on the website www.orpheudecor.com are subject to availability. If your order cannot be supplied, ORPHEU DECOR reserves the right to notify you about this occurrence and to reimburse you on the full amount paid.

PLACING AN ORDER

To place an order, you just need to find the products you want and add them to the shopping cart. Once you have gathered all the products in your cart, you may proceed to checkout. To finalize your order, you will be asked to fill in a formulary with some information. Afterwards, you just need to choose a payment method and follow the steps indicated for a successful order processing.

PAYMENT METHODS

ORPHEU DECOR offers several payment solutions in order to make your ordering process as comfortable as possible. The payment methods available are as follows:

Credit Card

If paying with credit card, you must enter all the requested data.

ATM Reference (Only available in Portugal)

After confirming your order, you will be provided with the payment information (entity, reference and amount). You have 3 days after placing the order to proceed with the payment. Payments can be made by ATM or Home banking.

PayPal

If you choose to pay for your order with PayPal, you will be redirected to the PayPal website, in order to finalise the payment. For more information, go to www.paypal.com.

Bank Transfer

When placing your order, you will receive a confirmation email with the information of the bank account to which you must make the transfer. You have 3 days after placing the order to proceed with the payment. After doing so, please send us a transfer receipt to info@orpheudecor.com, writing the order number in the email subject. The order shall only be processed after receipt of payment.

 

SHIPPING & DELIVERY

Your order will only be processed once its payment has been confirmed.

In case of payments made with Credit Card, ATM Reference or PayPal, your order will be immediately processed, unless there is any difficulty for reasons beyond ORPHEU DECOR.

If the payment is made by bank transfer, the order processing will only begin after confirmation of the transfer by ORPHEU DECOR’s bank, with the confirmation period varying according to the country of origin of the transfer.

Please note that some payment methods may not be available for some countries.

The estimated delivery time displayed on each product page is purely indicative. Except in rare situations, the period shown on the website for each of the products is met. Please note that a late delivery may occur due to reasons beyond ORPHEU DECOR. Therefore, we will not accept liability for any harm caused by delays in the delivery process.

To conveniently receive your order, simply indicate the correct and full delivery address at the end of your order, so that the carrier can process the shipment. Orders will be delivered on working days. You should ensure that there is someone responsible for receiving the order at the address provided. Orders are not accepted for deliveries to post office boxes.

When your order arrives, the person in the provided address will be asked to sign a delivery receipt. That person shall be responsible for receiving the order and for delivering it to the Customer.

When receiving your order, you should check if it has any visible anomaly that may have been caused during transport. If there is, please accept the parcel, but write down the visible damages at the transport guide before signing it.

Upon delivery, the Customer becomes responsible for any loss or damage to the goods.

If an order is sent back to ORPHEU DECOR for reasons beyond our control, namely the absence of someone at the delivery address, or the wrong or incomplete indication of the delivery address, the costs associated with a new shipment will be borne by the Customer.

We work with well-known international carriers. Whenever they are not allowed to deliver the goods at the address provided by the Customer, for circumstances beyond ORPHEU DECOR’s control, such as customs restrictions at the destination country, among others; ORPHEU DECOR does not take any responsibility for and reserves the right to cancel the order and, consequently, reimburse the Customer.

ORPHEU DECOR has no control or responsibility for any costs associated with customs duties and import taxes that may be applied in the destination country. It is the Customer who should ask about such fees and, consequently, pay for them.

When there is a refusal to receive the parcel and/or pay import duties in the country of destination, and the parcel is sent back to ORPHEU DECOR, the Customer is entitled to cancel the order and get a refund. Nevertheless, any costs resulting from the products being shipped back to ORPHEU DECOR shall be deducted from the amount to be reimbursed.

SHIPPING COSTS

Shipping costs entail the transport of goods from ORPHEU DECOR facilities to the delivery address provided by the Customer, and do not include any import duties charged in the country of destination.

Shipping costs vary according to the purchase value and country of destination. Note that free shipping is possible for purchases above a certain value. Otherwise, the price charged for shipment is: EUR5.90 for purchases below EUR60 with delivery to Mainland Portugal; EUR17.90 for purchases below EUR200 with delivery to European Union; and EUR35 for purchases below EUR350 with delivery to Outside of European Union (except Switzerland, Australia and Norway).

The conditions of the shipping costs provided in this website shall only apply to a carrier selected by ORPHEU DECOR. ORPHEU DECOR reserves the right to refuse the shipment of its products by a different transport company.

DELIVERY TIME

The estimated delivery time in each product page applies to deliveries to Mainland Portugal and is expressed in weeks or working days. For deliveries outside Mainland Portugal, there may be an additional transit time.

Note that delivery times may be different for larger orders or purchases with special characteristics. In case of doubt, please contact us through any of the contact information displayed on our website.

ORDER CANCELLATION

You may cancel your purchase order only if it has not yet been processed. For that, please notify ORPHEU DECOR as promptly as possible, by email written to info@orpheudecor.com

RETURNS & REFUNDS

According to the Decree-Law no. 24/2014 of February 14, the Customer has a period of 14 days from the date of receiving the order to exercise the right to return products, without paying any indemnity.

In order to exercise the right to return products, you must first notify ORPHEU DECOR of your decision, by means of an unequivocal statement sent by electronic mail to info@orpheudecor.com. The reception will be confirmed within the maximum period of 24 hours. If within 24 hours the Customer receives no response from ORPHEU DECOR, we request that you contact us by telephone.

The right of free dissolution of the contract shall not apply to:

  • Custom orders;
  • Supply of goods made according to consumer specifications or manifestly personalized (custom order);
  • Supply of goods which, by their nature, cannot be returned or are liable to deterioration or to quickly expire;
  • Supply of goods not subject to return, for reasons of health protection or hygiene (the cutlery and dinnerware are designed for personal use and, as such, no returns are permitted after use);
  • Supply of goods which, after delivery and by nature, get inseparably mixed with other products;
  • Supply of sealed audio or video recordings, as well as sealed software, where the consumer has removed the inviolability seal after delivery.

ORPHEU DECOR will not accept items returned by cash on delivery.

To be returned, the products must be in their original package and be fully complete, without any signs of use, in perfect conditions. The items must be accompanied by an invoice at all times, as well as by any component that makes part of the product, namely manuals, documents and accessories. The products that do not meet these requirements will not be accepted for return.

In case of return, the Customer will be reimbursed for all payments made, including shipping costs. However, any original customs duties or cost resulting from returning the products shall be borne entirely by the Customer.

Refunds will be made by the same payment method used in the payment of the order, except for payments made with ATM Reference, which will be reimbursed by bank transfer, within 14 days of receipt of the products.

ORPHEU DECOR reserves the right to withhold the refund while the goods are not received or for cases in which the products do not arrive in perfect conditions at ORPHEU DECOR facilities.

ALTERNATIVE DISPUTE RESOLUTION

APPLICABLE LAW AND JURISPRUDENCE

These General Terms and Conditions of Hiring and Use, as well as all contracts concluded under them on the website www.orpheudecor.com, are governed by Portuguese law. In case of dispute or divergence of interpretation regarding these General Terms and Conditions of Hiring and Use, the parts shall be listened by the competent Portuguese Court.
